The Current Legal Framework: Strengths and Limitations

The 1951 Refugee Convention and its 1967 Protocol form the cornerstone of international refugee law. These treaties define the concept of a refugee and establish the principle of non-refoulement, prohibiting the return of refugees to countries where they face persecution.

While this framework has provided a vital foundation for refugee protection, it has faced significant challenges in recent years. The surge in forced displacement, the emergence of protracted refugee situations, and the rise of xenophobic and anti-refugee sentiments have exposed its limitations.

Gaps and Shortcomings in Refugee Law

Some of the key gaps and shortcomings in refugee law include:

  • Lack of protection for internally displaced persons (IDPs). Millions of people are displaced within their own countries and are not fully covered by the Refugee Convention.
  • Insufficient recognition of climate-induced displacement. Climate change is increasingly becoming a major driver of displacement, but refugee law does not adequately address this issue.
  • Limited access to asylum procedures. Many refugees face barriers in accessing fair and efficient asylum procedures, leaving them vulnerable to deportation.
  • Detention of refugees and asylum seekers. In many countries, refugees and asylum seekers are detained in inhumane conditions, violating their human rights.

The Imperative for Revision

These gaps and shortcomings have led to a growing call for the revision of refugee law. A revised framework must address the following imperatives:

  • Expand protection to all forcibly displaced persons. This includes IDPs, climate refugees, and other vulnerable populations.
  • Strengthen access to asylum procedures. All refugees should have access to fair and efficient asylum processes that respect their dignity and human rights.
  • End the detention of refugees and asylum seekers. Detention should only be used as a last resort and for the shortest possible time.
  • Promote durable solutions. Refugee law should focus not only on immediate protection but also on long-term solutions such as resettlement and integration.

Progressive Reforms for a Human Rights-Based Refugee Law

To achieve a human rights-based refugee law, the following progressive reforms are essential:

  • Adopt a comprehensive definition of a refugee. This definition should include persons fleeing persecution, violence, or other serious human rights violations, as well as those displaced by climate change.
  • Establish a global asylum system. This system would provide a fair and efficient process for all refugees to seek asylum, regardless of their location.
  • Promote international cooperation on refugee protection. All countries have a responsibility to protect refugees, and this responsibility should be shared equitably through mechanisms such as resettlement and financial assistance.
  • Monitor and enforce compliance with refugee law. An independent body should be established to monitor compliance with refugee law and hold violators accountable.

The revision of refugee law is an urgent and necessary task. By addressing the gaps and shortcomings in the current framework and implementing progressive reforms, we can create a legal framework that fully respects human rights, protects the most vulnerable, and promotes durable solutions for refugees.

As global migration challenges continue to evolve, it is imperative that we work together to ensure that human dignity and rights remain at the heart of our response.
